Chapter 11 : Chapter 11 bankruptcy is also known as “reorganization.”  Although Chapter 11 is implemented in a few personal cases, it was primarily designed for businesses.  This type of bankruptcy centers around the creation and proposal of a plan of repayment to your creditors.  Your creditors then have an opportunity to vote for the plan.  The process and number of votes required to a successful plan are something that should be discussed with an attorney.  Meanwhile, a Chapter 11 case also allows you to remain in control of the day-to-day business until the court says so, as well as removing some of the burden in leases and contracts.  You also have the opportunity to object to the claims of your creditors.

Legal Fees

Due to the differing nature of legal matters, the basis for fees may vary. Generally, billing for most cases will be determined by the amount of time required. Other factors (i.e., complexity of case, special expertise required, etc.) may also be considered in arriving at a final statement. Certain matters may be billed on a flat fee basis, while others, such as personal injury cases, may be handled on a contingency basis, with the fee being a percentage of the recovery obtained. Charges for certain real estate and business transactions are sometimes established through the monetary amounts involved in the transaction or according to the complexity of the transactions.
